If you receive certain types of criminal convictions in California, you may have concerns about whether you will be able to retain ownership of your guns. There are many criminal convictions and other circumstances that make it unlawful to possess a firearm within the state, and if you receive or meet one or more of them, you may indeed have your gun rights stripped away.
Criminal convictions that prohibit gun ownership
If you receive a California felony conviction, or if you receive a conviction for any other type of offense outlined in California Penal Code sections 29900 or 29905, you will no longer have the right to possess firearms within the state. Certain misdemeanors, among them those specified by California Penal Code section 29805, also strip away your right to possess guns.
If you receive an indictment for a federal crime punishable by a year or more behind bars, this, too, means you may no longer possess a gun in California. Furthermore, your guns rights will also be taken away if you threaten someone specific in the presence of a licensed psychotherapist and that therapist reports your threats to authorities.
Other circumstances that prevent gun ownership
If someone has taken out a temporary restraining or protective order on you, this also hinders your ability to possess firearms. The same holds true if a court finds you mentally incompetent to stand trial, not guilty by reason of insanity or otherwise a danger to yourself or others as a result of mental illness.
If you are currently under a conservatorship because of a disability relating to mental illness or alcoholism, that also prevents you from being able to possess a gun in California, as does an addiction to narcotics. A dishonorable discharge from the U.S. Armed Forces will also prohibit you from possessing guns, and if you are a fugitive from justice because of a federal crime, that, too, means you cannot lawfully possess a gun.
While these are some of the circumstances that can strip away your right to own a gun in California, this is not an exhaustive list.
